MEET THE BOARD
Our Board members at the Elko Senior Center play a vital role in guiding and shaping the direction of services and programs provided to the community. They provide essential leadership, oversight, and strategic direction, ensuring the Senior Center effectively meets the needs of our senior residents. Their commitment helps strengthen our center’s impact and ensures we continue to serve the community with relevant and meaningful programs.
 
Elko Senior Citizens Center, Inc. (ESCC) is an independent nonprofit organization incorporated in, and granted tax-exempt status by, the State of Nevada. ESCC has been granted 501(c)(3) charitable status by the Internal Revenue Service.
The Board of Directors currently consists of seven volunteers. These volunteers make up the membership of the Corporation and have complete authority to make changes to the Bylaws and Articles of Incorporation as they see necessary.
Meetings are generally held the third (3rd) Monday of each month.
As an independent organization, meetings of the Board of Directors are not subject to the Nevada Open Meeting Law*, nor are they required to be public. The Board of Directors has the authority to enter into closed session at any time. The Board also has the authority to restrict, and/or eliminate, public comment at their discretion.
 
*NRS 241.020 provides:

  1. Except as otherwise provided by specific statute, all meetings of public bodies must be open and public, and all persons must be permitted to attend any meeting of these public bodies (emphasis added).

 
NRS 241.015(4) defines public bodies as meeting any 1 of the following 4 tests:

  1. Any administrative, advisory, executive or legislative body of the State or a local government consisting of at least two persons performing specific duties;

  2. Any board, commission or committee consisting of at least two persons appointed by specific government officials or government entities;

  3. A limited-purpose association that is created for a rural agricultural residential

common-interest community as defined in subsection 6 of NRS 116.1201; or

  1. A subcommittee or working group consisting of at least two persons who are appointed by a public body described in 1-3 above.

 
Since ESCC is not an administrative, advisory, executive or legislative body of the County of Elko, State of Nevada, or any other government, Test 1 does not apply.  Since ESCC is a private, non-profit corporation created by the filing of Articles of Incorporation with the Nevada Secretary of State, Tests # 2 – 4 do not apply.  Therefore, ESCC is not subject to the Nevada
Open Meeting Law.
